Welcome to Pemberton & Grey. By accessing our website at www.pemberton-grey.com and placing an order, you agree to be bound by the following Terms and Conditions. Please read them carefully before making a purchase. Your purchase is protected under the Australian Consumer Law (ACL), which is contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
1. PRODUCT INFORMATION
We aim to display and describe all products as accurately as possible. Colours may vary slightly due to screen settings or lighting conditions. All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Promotions and special offers are valid while stock lasts or for the duration of the stated promotion period.
2. ORDERING AND PAYMENT
Orders can be placed directly through our website at www.pemberton-grey.com. We accept the following payment methods: Visa, Mastercard, American Express, Apple Pay, Google Pay and Shop Pay. Your order is processed once payment has been successfully received. In the case of obvious pricing errors, stock inaccuracies, or incorrect product information, we reserve the right to cancel or adjust the order. You will be notified promptly if this occurs.
3. SHIPPING AND DELIVERY
Delivery within Australia typically takes 7–14 working days depending on your location. Order processing time is 1–3 working days. Orders placed on weekends or public holidays are processed on the next business day. We offer free shipping on all Australian orders. We are not liable for delays caused by carriers, natural events, or peak-season congestion. Once your order has been shipped, you will receive a confirmation email including tracking details where available.
4. RETURNS AND REFUNDS
Your statutory rights under Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our voluntary returns policy
In addition to your statutory rights, we offer the following voluntary return policy for change-of-mind purchases: you may return items within 30 days of receiving your order, provided items are unused, unworn and in their original condition including all original packaging and tags. Return shipping costs for change-of-mind returns are the responsibility of the customer.
Once we receive and inspect your return, refunds are issued within 7–14 business days to your original payment method.

5. EXCEPTIONS TO VOLUNTARY RETURNS
The following items cannot be returned under our voluntary change-of-mind policy unless they are faulty or incorrectly sent: items returned in used, worn, or damaged condition not caused by a manufacturing defect, and items returned without original packaging or tags.
Note: these exceptions do not affect your rights under the Australian Consumer Law in relation to faulty or non-compliant goods.
6. FAULTY OR INCORRECT ITEMS
If you receive a faulty or incorrect item, please contact us at support@shop-pembertongrey.com as soon as reasonably practicable after discovery of the fault. Under the Australian Consumer Law, you are entitled to a remedy — replacement, repair or full refund — for any item that is faulty, unsafe, significantly different from its description, or fails to do what we said it would. We will cover all return shipping costs for faulty or incorrectly sent items. Your rights under the Australian Consumer Law are not limited by anything in these Terms and Conditions.
7. CONSUMER RIGHTS
Nothing in these Terms and Conditions limits or excludes your rights under the Australian Consumer Law or any other applicable Australian legislation. For further information about your consumer rights, you may contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or your relevant state or territory consumer protection agency.
8. LIABILITY
Pemberton & Grey is not liable for indirect loss, consequential loss, or loss of profits arising from your use of our website or products, except where such liability cannot be excluded under the Australian Consumer Law or other applicable Australian legislation. Nothing in these Terms excludes liability for negligence, fraud, or misrepresentation.
9. FORCE MAJEURE
We are not responsible for delays or failure to deliver due to circumstances beyond our reasonable control, including but not limited to natural disasters, carrier disruptions, strikes, system outages, customs delays, or severe weather conditions. We will make every reasonable effort to communicate delays and resolve them promptly.
10. GOVERNING LAW
These Terms and Conditions are governed by the laws of Australia. Any disputes will first be addressed through direct communication and good-faith resolution efforts. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the competent courts of Australia. Consumers may also seek assistance from the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or their relevant state or territory consumer protection agency.
11. PRIVACY
Your personal information is collected and handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
